Under South Carolina Code Section 61-2-145, any licensed business selling alcoholic beverages for on-premises consumption between midnight and 4 a.m. is now legally required to use a forensic digital identification system to validate the ID of anyone attempting to enter the premises.

The law targets precisely the hours when venues face the greatest risk: the late-night window where fake IDs are most commonly used, alcohol-related incidents are most likely to occur, and liability exposure is at its peak. By mandating forensic scanning during these hours, South Carolina is joining a growing number of states taking a proactive, technology-driven approach to venue safety.

What the Law Requires

Forensic digital ID systems must scan the barcode on an identification card and cross-reference it against a Department of Motor Vehicles database to confirm the holder is of legal drinking age. Critically, systems that merely check that the barcode matches the front of the card are not sufficient. The SCDOR requires analysis for typographical errors, jumbled or incorrect data, misplaced information, and secret coding that distinguishes genuine IDs from sophisticated counterfeits.

 

What "Forensic" Really Means and Why It Matters

The word forensic is doing a lot of work in this legislation, and it's worth understanding why. A standard ID check, even one using a basic barcode reader, can be fooled by modern counterfeit IDs that are increasingly convincing to the naked eye. A forensic system, by contrast, examines the underlying data structure of the ID itself.

That reduction, combined with other available mitigation factors (such as stopping alcohol service by midnight, completing approved server training, and keeping alcohol sales below 40% of total revenue) means a venue could potentially reduce its required coverage down to the minimum permanent licensee floor of $300,000. That translates directly to real premium savings, year after year.

Mitigation Factor #4

To claim the forensic scanner mitigation factor, venues must submit the make and model of their approved system along with either proof of purchase or subscription information to the SCDOR. Collegiate Sports Venues: An Additional Mandate
